Terms of Service

Effective date: 30 October 2026 · Version: 1.0

These Terms of Service ("Terms") are a binding agreement between you and Sanvri LLC, a North Carolina limited liability company doing business as GiftedCub ("GiftedCub," "we," "us," "our"). They govern your use of giftedcub.com, our practice activities, reports, printables and related services (together, the "Service").

The short version

This box summarizes the Terms in plain words. The full Terms below are what count.

  • Who can sign up: parents and legal guardians aged 18+ in the United States. Children practise only inside a profile their parent creates.
  • What GiftedCub is: original practice questions in the style of gifted-program tests. We are not connected to any test publisher, school or district, and we cannot guarantee any score, placement or admission.
  • Plans: a free plan, and paid plans shown on the pricing page. Monthly and annual plans renew automatically until you cancel; the Season Pass is a one-time payment and does not renew. We email you at least 7 days before an annual plan renews.
  • Cancelling: any time, online, in two clicks (Settings → Manage billing, invoices & cancel). You keep access until the end of the period you paid for.
  • Refunds: if your first purchase isn't right for your family, email us within 3 days for a full refund. After that, payments are not refunded.
  • Fair use: for your own household only. Please don't share accounts, copy our questions or use them commercially.
  • Disputes: we try to sort out any problem informally first. If that fails, most disputes go to individual arbitration, not court, and there are no class actions. You can opt out of arbitration within 30 days of agreeing (Section 17.9). Claims must be brought within one year. Small claims court is always open to you.
  • Contact: hello@giftedcub.com · +1 (980) 229-8093.
PLEASE READ SECTION 17 (DISPUTE RESOLUTION) CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES THROUGH INDIVIDUAL BINDING ARBITRATION, NOT IN COURT; WAIVES JURY TRIALS AND CLASS ACTIONS; AND SETS A ONE-YEAR DEADLINE FOR CLAIMS. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS (SECTION 17.9).

By checking the box that says you agree to these Terms, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

In plain words: the account is yours, you are responsible for how your children use it, and it is for your household only.

1.1 Parents and guardians only. Accounts may be created only by a parent or legal guardian who is at least 18 years old and lives in the United States ("Parent," "you"). Children may use the Service only through a child profile created and supervised by their Parent.

1.2 You accept for your child. You agree to these Terms on your own behalf and on behalf of each child for whom you create a profile. You are responsible for your child's use of the Service and for making sure it complies with these Terms.

1.3 Accurate information. You agree to give accurate account information and keep it current. You are responsible for all activity under your account and for keeping access to your email inbox and Google account (which you use to sign in) secure. Tell us promptly at hello@giftedcub.com if you suspect unauthorized use.

1.4 One family per account. An account is for one household. You may not share, sell or transfer access outside your household.

2. What GiftedCub is — and is not

In plain words: practice to make the test format familiar. Not the real test, not linked to any publisher or school, no promised results, and our readiness estimates are not official scores. Always check dates and rules with your district.

2.1 Practice and familiarization only. GiftedCub provides original practice questions, activities and reports designed to help children become familiar with the formats of certain ability and aptitude tests used in gifted-program and school admissions.

2.2 Not affiliated with any test publisher, school or district. GiftedCub is independent. We are not affiliated with, endorsed by or sponsored by any test publisher (including Riverside Assessments, LLC; Pearson Education, Inc.; or Multi-Health Systems Inc.), any school district, or any school. Test names are used only to describe which formats our original practice material resembles. See our Disclaimers.

2.3 No real test items. Our questions are original and are not taken from any actual test. You agree not to submit, upload or share any real or confidential test content with us or through the Service.

2.4 No guarantee of results. WE DO NOT GUARANTEE ANY TEST SCORE, PERCENTILE, PROGRAM ELIGIBILITY, ADMISSION, PLACEMENT OR OTHER OUTCOME. Results on any test depend on many factors outside our control, including the child, the test, the testing day and the school or district's own rules and decisions.

2.5 Estimates, not scores. Any "readiness" level, band, estimate, percentile or report we show is an informal estimate based on practice activity on our Service. It is not an official score, is not normed against any official test, and must not be used as the basis for any educational, medical or psychological decision.

2.6 Not professional advice. We are not psychologists, licensed evaluators, educational consultants or a school. Nothing in the Service is a diagnosis, assessment of giftedness, or professional, educational, medical or legal advice.

2.7 District and school information. Information about districts, programs, testing windows, deadlines, eligibility criteria and cutoffs is compiled from public sources, may change without notice, and may contain errors. Always confirm dates, deadlines and requirements directly with the school or district. We are not responsible for any missed deadline, registration, or decision made in reliance on that information.

3. Plans, payment and automatic renewal

In plain words: monthly and annual plans renew until you cancel; the Season Pass doesn't renew. Cancel online any time and keep what you paid for. We remind you before an annual renewal and give 30 days' notice of any price rise.

3.1 Plans. Plans, features and prices are described on our pricing page and at checkout. Today they are: a free plan with limited daily practice; a Monthly plan that renews every month; an Annual plan that renews every year; and a Season Pass, a one-time payment for 122 days of access that does not renew. Prices are in U.S. dollars and do not include any applicable taxes, which we may collect where required.

3.2 Payment. Payments are processed by our payment processor, Stripe. By purchasing, you authorize us (through Stripe) to charge your payment method for the plan you select and any applicable taxes. We do not store your full card number.

3.3 AUTOMATIC RENEWAL. IF YOU CHOOSE A RECURRING PLAN (FOR EXAMPLE, MONTHLY OR ANNUAL), YOUR PLAN WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD, AND WE WILL CHARGE YOUR PAYMENT METHOD THE THEN-CURRENT PRICE FOR THE SAME PERIOD, UNTIL YOU CANCEL. The price, billing frequency and how to cancel are shown at checkout before you pay. One-time plans (such as a fixed-length season pass) do not renew unless stated at checkout.

3.4 Cancel anytime, online. You can cancel a recurring plan at any time in Settings → Manage billing, invoices & cancel, or by emailing hello@giftedcub.com. Cancellation stops future renewals; you keep access until the end of the period you already paid for.

3.5 Renewal reminders and price changes. For annual plans, we will email you a reminder at least 7 days before each renewal. We will give you at least 30 days' notice by email before any price increase applies to your plan, and you can cancel before it takes effect.

3.6 Failed payments. If a payment fails, we may retry it and may suspend paid features until payment succeeds.

4. Refunds

In plain words: a full refund on your first purchase if you ask within 3 days. After that, no refunds, but cancelling always stops future charges.

4.1 3-day satisfaction refund. If you are not satisfied with your first purchase of any paid plan, email hello@giftedcub.com within 3 days of purchase and we will refund it in full.

4.2 After 3 days. Except as stated in Section 4.1, Sections 11, 12.2 and 19.1, or as required by law, payments are non-refundable and we do not give partial refunds for unused time. Cancelling stops future charges (Section 3.4).

4.3 Please contact us first. If you have a billing problem, please contact us before disputing a charge with your bank; most issues can be fixed quickly. If a chargeback is filed, we may suspend the account while it is resolved.

5. License to use the Service

In plain words: use GiftedCub and print our printables at home, for your own family.

5.1 Subject to these Terms and your payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your household's private, non-commercial educational use.

5.2 Printables. You may print materials we make available for use within your household. You may not distribute, sell, publish or post them.

6. Acceptable use

In plain words: no copying or reselling our questions, no tutoring business on our account, no bots, no real test items, and use a nickname for your child, never their real name.

You agree not to, and not to help anyone else to: (a) copy, scrape, download in bulk, reproduce, resell, sublicense or redistribute any part of the Service, including questions, explanations, audio, images or reports; (b) use the Service for tutoring, classes, test-prep services or any other commercial purpose without our written permission; (c) share login credentials outside your household or create accounts by automated means; (d) reverse engineer, decompile or attempt to extract source code, question banks or algorithms, except where the law expressly permits it; (e) use any robot, spider, crawler or other automated means to access the Service, or use the Service to train any machine-learning or AI model; (f) interfere with or disrupt the Service, its security or its infrastructure, or attempt to access accounts or data that are not yours; (g) upload or share real or confidential test items, or content that is unlawful, harmful or infringes anyone's rights; (h) enter a child's real full name, photo, address, school name or other identifying details in any child profile field (use a nickname); (i) use the Service in violation of any law.

7. Our intellectual property

In plain words: the questions, pictures, audio and software are ours.

The Service and all of its content — including questions, explanations, figures, audio, software, designs, the GiftedCub name and logo — are owned by Sanvri LLC or its licensors and are protected by copyright, trademark and other laws. Except for the limited license in Section 5, no rights are granted to you. "GiftedCub" and the GiftedCub logo are trademarks of Sanvri LLC.

8. Your content and feedback

In plain words: we use your child's answers to run their practice, and combined answers with no names attached to measure how hard each question is.

8.1 Practice data. As your child uses the Service, we record answers, timing and progress ("Practice Data"). We use Practice Data as described in our Privacy Policy. You grant us a license to use Practice Data to provide and improve the Service, including in de-identified and aggregated form to calibrate question difficulty and improve our materials. De-identified data cannot reasonably be linked to you or your child.

8.2 Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

9. Privacy and children

Our Privacy Policy explains what we collect and how we use it, including our practices under the Children's Online Privacy Protection Act (COPPA). We do not sell personal information and we do not show advertising to children.

10. Third-party services

The Service relies on third-party providers (for example, hosting, payments, email and sign-in). Your use of features provided through third parties may also be subject to their terms. We are not responsible for third-party websites or services that we link to but do not control.

11. Changes to the Service

In plain words: features may change; if we shut down a plan you prepaid, you get the unused part back.

We may add, change, suspend or discontinue features at any time. If we permanently discontinue a paid plan you have prepaid, we will refund the unused portion of your prepaid period.

12. Suspension and termination

In plain words: you can close your account any time. We close accounts only for serious misuse or non-payment, usually after a warning.

12.1 You may close your account at any time in Settings → Delete my account or by emailing us.

12.2 We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that could cause harm or legal liability, or if required by law. Where reasonable, we will give notice and an opportunity to fix the problem first. If we terminate without cause, we will refund the unused portion of any prepaid period.

12.3 Sections 2, 4.2, 6, 7, 8, 13–19 survive termination.

13. DISCLAIMER OF WARRANTIES

In plain words: we work hard to get things right, but the Service comes as it is, without promises that it is error-free or that it will change any test result.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, ESTIMATES, REPORTS AND INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL IMPROVE ANY TEST SCORE OR RESULT IN ANY ELIGIBILITY, ADMISSION OR PLACEMENT; (B) ANY QUESTION, ANSWER, EXPLANATION, ESTIMATE OR DISTRICT INFORMATION IS ACCURATE, COMPLETE OR CURRENT; (C) OUR MATERIALS MATCH THE CONTENT, DIFFICULTY OR FORMAT OF ANY ACTUAL TEST; OR (D) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

14. LIMITATION OF LIABILITY

In plain words: if something goes wrong, the most we owe is what you paid us in the last 12 months, or $50 if that is more. We are not liable for indirect losses such as a missed placement. Limits the law does not allow do not apply.

14.1 TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SANVRI LLC, GIFTEDCUB, OR ITS MEMBERS, MANAGERS, CONTRACTORS, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF OPPORTUNITY, EDUCATIONAL OPPORTUNITY, ADMISSION, PLACEMENT, SCHOLARSHIP, TUITION, PROFITS, DATA OR GOODWILL, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

14.3 These limits apply even if a remedy fails of its essential purpose, and they reflect an essential basis of the bargain between you and us; our prices would be higher without them.

14.4 Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the exclusions and limits above apply only to the extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence or willful misconduct.

15. Indemnity

In plain words: if someone else makes a claim against us because of your misuse of the Service, you cover our costs.

To the extent permitted by law, you agree to defend, indemnify and hold harmless Sanvri LLC and its members, managers, contractors and agents from any third-party claims, losses, damages and expenses (including reasonable attorneys' fees) arising from (a) your or your child's misuse of the Service, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

16. Time limit for claims

In plain words: any claim must be brought within one year.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS MUST BE FILED (IN ARBITRATION OR, WHERE PERMITTED, IN COURT) WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE; OTHERWISE IT IS PERMANENTLY BARRED. The time to file is paused while the informal dispute process in Section 17.2 is under way.

17. DISPUTE RESOLUTION: INFORMAL RESOLUTION, BINDING INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER

In plain words: if you have a problem, write to us first and we have 60 days to try to fix it. If we can't, it goes to a single arbitrator (usually by video), not a court, one person at a time, with no class actions or juries. We pay the arbitration costs beyond the consumer filing fee. Small claims court is still open to you. You can opt out of arbitration by emailing us within 30 days of agreeing (17.9).

17.1 Scope. This Section applies to any dispute, claim or controversy between you (including on behalf of your child) and us arising out of or relating to the Service, these Terms, our Privacy Policy, or any purchase, whether based on contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether it arose before or after you agreed to these Terms ("Dispute").

17.2 Informal resolution first (mandatory). Before starting arbitration or a small-claims case, the party with a Dispute must send a written notice to the other ("Notice"). Notices to us go to hello@giftedcub.com (subject "Legal Notice") and to Sanvri LLC, 7015 Walnut Branch Lane, Charlotte, NC 28277. The Notice must include your name, account email, a description of the Dispute and the relief requested, and must be personally signed by you (not only by a lawyer). For 60 days after the Notice is received, the parties will try in good faith to resolve the Dispute, including, if either party asks, through an individual telephone or video conference that you (and your lawyer, if any) personally attend. Neither party may start arbitration until this process is complete. Any applicable time limit is paused during this period. A court may enforce this requirement and may stay or dismiss any arbitration filed in violation of it.

17.3 Binding individual arbitration. If the Dispute is not resolved under Section 17.2, it will be resolved by binding individual arbitration, not in court, except as stated in Section 17.4. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs this Section. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, as modified by these Terms (see adr.org). A single arbitrator will decide the Dispute. The arbitrator may award the same individual relief a court could award, but only in favor of the individual party seeking relief and only to the extent needed to provide relief warranted by that party's individual claim.

17.4 Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies and stays there on an individual basis; and (b) seek an injunction in court to stop actual or threatened infringement, misappropriation or misuse of intellectual property or unauthorized access to the Service.

17.5 CLASS ACTION AND JURY TRIAL WAIVER. YOU AND WE AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims (except as provided in Section 17.7) and may not preside over any form of class or representative proceeding. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If a court finally decides that applicable law precludes enforcement of any part of this Section 17.5 as to a particular claim or remedy (such as public injunctive relief), then that claim or remedy (and only that claim or remedy) will be severed and decided in court after the individual arbitration of all other claims, and the court proceeding will be stayed until the arbitration is complete.

17.6 Fees and location. Your filing fee will not exceed the amount AAA's Consumer Rules require a consumer to pay; we will pay all other AAA administrative and arbitrator fees required by those rules. If the arbitrator finds that your claim or the relief sought was frivolous or brought for an improper purpose, fees will be allocated as AAA rules and applicable law allow. Unless the parties agree otherwise, any hearing will take place by video or telephone, or, if in person, in the county where you live. The arbitrator's award is final and binding and may be entered in any court with jurisdiction.

17.7 Mass filings. If 25 or more similar Demands for Arbitration are filed against us by or with the help of the same or coordinated counsel or organization ("Mass Filing"): (a) the Section 17.2 process must be completed for each claimant; (b) AAA's Mass Arbitration Supplementary Rules will apply; (c) the claims will be administered in batches of no more than 10 claimants each, with only one batch proceeding at a time and fees for later batches not due until those batches proceed; (d) the parties will in good faith select up to 10 bellwether cases to proceed first, and the remaining cases will be paused until those are resolved, after which the parties will mediate the remaining claims before any further arbitration proceeds; and (e) all applicable time limits are paused for claims in later batches until they proceed. A court may enforce this Section 17.7, including by enjoining a Mass Filing or the assessment of fees that do not comply with it.

17.8 Who decides. The arbitrator decides all issues relating to the interpretation, applicability, enforceability or formation of this arbitration agreement, except that a court decides (a) whether Sections 17.2, 17.5 or 17.7 are enforceable or have been complied with, and (b) any issue relating to whether a Dispute may proceed on a class, collective, consolidated, representative or Mass Filing basis.

17.9 30-DAY RIGHT TO OPT OUT. You may opt out of this Section 17 (except Sections 17.2 and 16) by emailing hello@giftedcub.com from your account email within 30 days after you first agree to these Terms, with the subject "Arbitration Opt-Out" and your name and account email. Opting out does not affect any other part of these Terms or your use of the Service. If you opt out, Disputes will be resolved in court as provided in Section 18.

17.10 Changes to this Section. If we make a material change to this Section 17, it will not apply to any Dispute of which we had written notice before the change. You may reject a material change by emailing us within 30 days after it takes effect, in which case the immediately prior version of this Section 17 continues to apply to you.

17.11 Severability of this Section. Except as stated in Section 17.5, if any part of this Section 17 is found unenforceable, the rest remains in effect. If Section 17.7 is found unenforceable as to a Mass Filing, the claims in that Mass Filing will proceed in court on an individual basis, not in arbitration.

18. Governing law and venue

In plain words: North Carolina law applies, and court cases (if any) are heard in Mecklenburg County.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Any Dispute not subject to arbitration (including if you opt out) will be brought exclusively in the state courts located in Mecklenburg County, North Carolina, or the U.S. District Court for the Western District of North Carolina, and both parties consent to personal jurisdiction there. This does not prevent either party from bringing a qualifying claim in small-claims court where you live.

19. General

19.1 Changes to these Terms. We may update these Terms. For material changes, we will notify you by email or in the Service at least 14 days before they take effect, and we may ask you to accept them again. If you do not agree, you may cancel before they take effect and receive a refund of any prepaid, unused period. Continued use after the effective date means you accept the updated Terms. Changes to Section 17 are governed by Section 17.10.

19.2 Electronic communications. You agree that we may provide notices, agreements and other communications electronically (by email to your account address or in the Service), and that electronic communications satisfy any requirement that they be in writing.

19.3 Entire agreement. These Terms, together with our Privacy Policy and any terms shown at checkout, are the entire agreement between you and us about the Service.

19.4 Severability; no waiver. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the rest will remain in effect (subject to Section 17.11). Our failure to enforce a provision is not a waiver.

19.5 Assignment. You may not assign these Terms. We may assign them, without notice, to an affiliate or to a successor in connection with a merger, reorganization, conversion or sale of all or part of our business.

19.6 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.

19.7 No third-party beneficiaries. These Terms do not give rights to anyone other than you and us.

19.8 Reviews. Nothing in these Terms limits your right to post honest reviews of the Service.
